I agree to abide by the rules and regulations of the Summerside Yacht Club as a club member and/or as a parent/guardian of a participant student in the Learn to Sail Program. Please read carefully: The Marina shall not be liable for any damages howsoever founded, arising out of any cause whatsoever (whether founded in tort or in contract or otherwise) and without limiting the generality of the foregoing claims arising out of any damage abatement or rescue efforts undertaken by Marina employees and/or members respecting the preservation of person or property and also including claims for consequential damages arising out of, occasioned by or attributable the nature, construction, design, condition or state of repair of the Marina or of the space and premises herein leased, nor arising out of occasioned by or attributable to the presence on rental, occupancy or use of the Marina or the space and premises herein leased by the owner or by any person visiting same or being thereon. The owner agrees to indemnify and save harmless the Marina from and against any and all claims howsoever founded, arising out of any cause whatsoever whether founded in tort or in contract or otherwise and without limiting the generality of the foregoing claims arising out of any damage abatement or rescue efforts undertaken by Marina employees and/or members respecting the preservation of person or property and also including claims for consequential damages arising out of or occasioned by or attributable to the nature, condition, design, condition or state of the Marina or the space and premises herein leased, whether founded in contract or in tort and in any manner based upon, occasioned by or attributable to this presence on, rental, occupancy or the use of the Marina or the space and premises herein leased by the Owner or by any person visiting same or being thereon whether founded in tort or in contract. The undersigned acknowledges having read the within limitation on liability and indemnity in its entirety and does voluntarily consent and agree to be bound to the terms therein contained as a condition to purchase by me of all marina services. For parents/guardians of participants in the Learn to Sail Program: I agree to have the student enrolled in the SYC “Learn to Sail Program”. I shall be responsible for his or her conduct. I understand that there shall be one verbal warning of misconduct. If there is occasion for a second warning, the child shall be sent home for the day. A third offence of misconduct or any “bullying” offence shall constitute automatic dismissal from the program without refund or any part of the fee. Liability Waiver As a condition of and in consideration of SYC accepting the entry of my child to participate as a student in the sailing school organized by it, the undersigned warrants and covenant as follows: That being fully knowledgeable of the risks of sailing participation by the Student in the sailing program of the Summerside Yacht Club, I do for myself, my executors, administrators and assigns arising out of the participation of the school, its related activities, together with any costs that may be incurred as a result of such claims; and to hereby covenant and agree to indemnify each of them against any such claims that the Student, his executors, administrators, successors and assigns or all of them may have with respect thereto.
